Summary, etc. يتناول كتاب (الفعل الضار والضمان فيه) والذي قام بتأليفه مصطفى أحمد الزرقا، موضوع (القانون) هذا الكتاب يضم دراسة وصياغة قانونية مؤصلة على نصوص الشريعة الإسلامية وفقهها انطلاقا من نصوص القانون المدني الأردني، مع مناقشة تفصيلية لمواد القانون المدني، هذا إلى جانب صياغة نهائية لنصوص مواد النظرية العامة للالتزامات كاملة كما أقرتها اللجنة العامة لمشروع قانون المعاملات المالية المذكور في جامعة الدول العربية بتونس سنة 1984م. الفعل الضار يعني كل تجاوز من أحد على آخر يلحق به ضررا في نفسه أو ماله أو كرامته، وفي حريته المشروعة ونشاطاته التي له حق ممارستها بمحض اختياره. فأي عمل أو نشاط ممنوع، وأي إهمال، مما يعتبر به الشخص مخطئا أو مقصرا، فإنه إذا ترتب عليه ضرر لغيره من جراء فعله أو إهماله يكون مسؤولا هو به تجاه المضرور، وتجب إزالة ضرره على حساب الفاعل المباشر أو المتسبب المخطئ أو المقصر.
